Marriage by proxy — This is when the bride or groom is represented by a proxy during the civil registration of the marriage. For example, the bride is not able to come to the ceremony and delegates to someone the authority to represent her interests. The authorized person acts on the basis of a notarized power of attorney executed by the bride, and instead of the bride, on her behalf, agrees to enter into marriage and signs all required papers. The proxy can be any adult citizen, whether Mexican or non-resident, who will be physically present at the civil registration ceremony of the marriage in Mexico.

Mexican law allows marriages to be registered by proxy and fully recognizes such marriages. In Russia, it is impossible to register a marriage by power of attorney, but at the same time, Russian legislation recognizes as valid foreign papers certifying the fact of a legal marriage outside the Russian Federation. The United States also recognizes marriages legally registered abroad.

After registering a marriage by proxy, a marriage certificate is issued. It is no different from the certificate obtained after registering an ordinary marriage. In order for such a certificate to be valid outside Mexico, it must also be apostilled.

The criteria for registering a marriage by proxy are exactly the same as for registering a regular marriage. And the list of required papers is exactly the same, plus a power of attorney. Registration of marriage by proxy in Mexico is possible for citizens of any nationality and for same-sex couples. HIV status does not matter.

Who might be interested in getting married in Mexico by proxy?

  • those who don’t want to fly to Mexico across the ocean, spend money on expensive flights and worry that they have the right to be denied entry,
  • groom — American, bride — She is Russian and has no right to come to Mexico. After the marriage has been registered by proxy, the spouse will return to the United States to file a CR1 spouse visa petition. But later, the spouses must still meet in any country to ensure the condition of personal communication to obtain such a visa,
  • groom — a citizen or resident of Mexico, and the bride will need a visa to enter Mexico. After registering the marriage by proxy, the husband pre-authorizes a visa for his wife at the migration service, the wife receives a resident visa at the Mexican consulate, enters using it and receives a Mexican resident card. A resident visa guarantees entry into Mexico,
  • the newlyweds are located in Mexico, but the bride — in Cancun, and the groom — in another city and is not able to fly to Cancun (in particular, he is busy with work or is afraid that he will be detained as an illegal immigrant). He has the right to prepare a power of attorney and give it to his wife,
  • groom — a non-resident is in a Mexican prison, and marriage to a Mexican woman can help him avoid deportation. This is a real case.
