If you are abroad, there are two ways to make a power of attorney for someone in your home country. Both have their pros and cons, but as a result, the issued power of attorney will allow you to perform actions on your behalf in your home country.
One way or another, the necessary requirements are:
- your personal presence,
- your valid passport or ID card — the notary must confirm your identity and verify your legal capacity,
- for minors: passports of the parent, child and original birth certificate. The birth certificate must be in a language understandable to the notary — more about this below,
- Full name of the authorized person and details of his passport, according to which he will perform actions on your behalf. It is better to have a photocopy of this document, but it is not necessary — You assume full responsibility for the accuracy of the authorized person’s passport data.
In this case, it does not matter what status you are in abroad: as a traveler or have resident status here.
Remember: when it comes to common children, one parent gives the other not a power of attorney, but a notarized consent.
Notarized power of attorney
In Mexico, a notarized power of attorney can be obtained from any notary office. In any city, a building with a Notaria sign — This is a notary office. Google does a great job of locating all Notarias.
The notary should clearly formulate what exactly you are giving the power of attorney for. But usually Mexican notaries issue a power of attorney with a very long text and with wide possibilities.
The power of attorney must be apostilled. This can be done at the government secretariat of the municipality where the notary is registered. Most often this is the city hall, unless the legal service is located in another building.

An apostilled power of attorney, issued by a notary abroad, should be transferred to your home country. There it must be translated into the language of your country. Most often, you should make a translation in a certified translation agency, and then have this translation certified by a domestic notary. In this case, the notary will not certify the power of attorney itself, but only the correctness of the translation. In some cases, translation certification does not need to — the power of attorney can be used with a simple transfer.
If the power of attorney is given on behalf of a minor, the notary will ask for the original of his birth certificate. If the birth certificate was not issued in Mexico, it must be apostilled in the country of issue, translated into Spanish in Mexico, and the translation certified by a sworn translator.
Consular power of attorney
In addition, a power of attorney can be obtained from the consulate of your country abroad. In Mexico, consulates of Ukraine, Russia and many other countries are located only in the capital, so you will have to fly to Mexico City in person. It is not possible to create a power of attorney remotely.
On the other hand, the power of attorney issued by the consular department will be immediately in the required language, and it will not need to be translated in your home country.

It is necessary to understand that the diplomatic mission is not involved in preparing the text of the power of attorney. The text should be prepared in advance by the principal and transmitted electronically according to thisaddress(for the Russian consulate) or when visiting the consulate. Next, the text will be transferred to the form and certified by the consular officer.

If a power of attorney is issued on behalf of a child, both the parent and the child must be present. The original birth certificate of the child is required. If the birth certificate was issued in Mexico, it must be apostilled and translated from Spanish, and the translation certified by the same consular department (additional charge).
Tariffs of consular fees for notarial acts depend on what kind of power of attorney is given and to whom. In particular, a power of attorney for the right to dispose of property for close relatives at the Ukrainian consulate will cost $30, at the Russian consulate — $42.
