For what purpose do married couples fly to Mexico for childbirth? The reasons can be very different, there are always several of them, but one of the most common — Give your child Mexican citizenship and gain access to the benefits that a Mexican passport provides when traveling around the world.
Every child who is born in Mexican territory has the unconditional right to become a citizen of that power. Parents and close relatives also have the opportunity to obtain Mexican passports by going through the naturalization procedure after two years.
After birth, the child is required to obtain a birth certificate, on the basis of which — passport. If the birth certificate is issued by a Mexican civil registry office, the child is automatically considered a Mexican citizen. Such citizenship does not even need to be confirmed. Accordingly, foreign parents are required to contact the diplomatic mission of their country of citizenship in Mexico in order to obtain a second citizenship for their child — of his state. When a child has two passports — Mexican and Russian, Ukrainian or other, he has all the rights of unhindered entry into both powers, and when traveling to other countries he has the opportunity to enjoy the advantages of a Mexican passport.
Although the procedure for obtaining Mexican citizenship for a child is considered one of the easiest in the world, for some parents the process itself “runs around with papers” causes irritation. It is now possible to obtain documentation for a newborn and obtain permanent residence for the parents in a month maximum. Until relatively recently, the entire process in Cancun could take 8 months. Some parents abandoned the process as it was (it cannot be stopped or paused) and left for their homeland.
At the same time, the question sometimes arose: does the child even need a Mexican passport if he already has the right to Mexican citizenship? The passport itself is now allowed to be obtained within a day, therefore the meaning of the question is different: why waste time and money if the main thing for us is — return home to Russia?
Is it possible not to receive a Mexican birth certificate, but to immediately get a Russian one? There is a possibility. But it will then be more difficult to obtain a Mexican passport by entering data into the Mexican civil registry. And it is advisable to do this before adulthood. At the same time, a child born in Mexico, in legal relations with Mexico, will still be considered a citizen of this country, and nothing more. In other words, to leave and enter Mexico, the child should use only a Mexican passport.
As long as a child born in Mexico travels with his parents, this rule may be violated. The child is given a Russian passport and is taken out of Mexico using it. The FMM migration card, which every non-resident should have, is issued upon departure.
Is it possible not to obtain Russian citizenship for a child at all?Permitted under certain conditions. But then the child will need a Russian visa to enter Russia. He will not be able to obtain it from the consulate in Mexico City if at least one of the parents is not a Mexican citizen.
Article 12 of the Federal Law «On Citizenship of the Russian Federation» states that a child acquires citizenship of the Russian Federation by birthright if both of his parents or a single parent have citizenship of the Russian Federation, regardless of the child’s place of birth. Russian parents do not have the right to choose whether or not to give their child Russian citizenship, even if they do not plan to live in Russia. According to the law, the child is already considered a citizen of Russia, and it is their duty to formalize this accordingly. Since the child is already Russian, he must enter Russia with a valid foreign passport of the Russian Federation, and not with a Russian visa in a Mexican passport.
If a child has one of the parents — foreign citizen, the situation is completely different. Then you already have the opportunity to choose whether to grant your child Russian citizenship or not. If parents jointly decide to give their child Russian citizenship, then the parent — A citizen of the Russian Federation follows this with the written consent of the second parent — a foreigner to apply to the consulate of the Russian Federation with an application for the child to acquire citizenship of the Russian Federation in a simplified manner, and after registration of this - with an application for issuing a foreign passport. If the parents have no desire to obtain Russian citizenship, then the foreign citizen parent has the opportunity to apply to the Russian consulate abroad with an application for a visa for their child, which is placed in the valid passport of the country of which the child is considered a citizen.
When entering Russia, a child with foreign citizenship will need to promptly submit a notification to the FMS authorities about the presence of a second citizenship. The responsibility to fulfill this criterion falls on the parents. Failure to submit a notification is subject to administrative and, in some cases, criminal liability.
In this regard, the most logical option is optimal: Mexican birth certificate + Mexican passport + second citizenship and Russian passport.
If obtaining a Russian passport takes too much time, try to get at the consulate not a passport, but a certificate of return to Russia, it’s faster. You will receive a Russian passport upon arrival in Russia.
Is it possible to obtain a Mexican passport in Russia? If the child was born in Mexico, then it is possible, and at any time. This is done by the Mexican consulates. The process is almost the same as obtaining a passport within Mexico. Base — Mexican birth certificate.
