One of the simplest mechanisms for acquiring a residence permit in Mexico is the program for resolving the migration situation. Those who have previously been to this country have the right to use it. The program is temporary, and you need to take advantage of it while it is still in effect.
If you meet the program criteria, you are entitled to obtain a temporary residence permit in Mexico for 4 years at once. After 4 years, without any conditions, you will be able to obtain permanent resident status, and after another year — apply for Mexican citizenship.
The main conditions of the program are as follows:
you were in Mexico in 2023 or earlier,you are now in Mexico,permitted length of stay at last entry (according to the stamp on the FMM or in the passport):any up to 180 days,has already expired, OR
Your resident card has expired and has not been renewed.
From March 2025, a resident card under the settlement program is issued under the only condition:you entered Mexico in 2022 or earlier and have not left the state since then.
We have described how to obtain a residence permit under the settlement program in other publications on our website. Let us briefly recall the algorithm:
- apply with your passport to the migration service,
- when approval open the procedure on the migration service website,
- make an appointment to visit a specific migration service office,
- draw up a letter justifying the request to issue a resident card for 4 years,
- pay state fees, three payments totaling from MXN 16,572 (2025) — the final amount depends on the amount of the fine assessed to you at a specific migration service office,
- come to the migration service office with a package of papers and receive a resident card.
But even if all three simple conditions are met, nuances are possible. For example, you entered Mexico in 2023 or earlier and have not left it since then — It will still cost you to apply for a residence permit. Or your latest FMMD form or the allowed period on the passport stamp is less than 180 days — Some migration service offices may apply this condition depending on nationality. Or for some reason there are no records of your entries in the migration database, but there are stamps in your passport. To be absolutely sure that you have the right to draw up a residence permit under the settlement program, you should personally contact the migration service office in your city.

Since then, the program standards have changed several times, but we have accumulated significant experience in communicating with migration service employees and studied all the nuances and options.
It happens that the requirements for obtaining a residence permit in different states of Mexico differ or there are additional standards, in particular, to confirm financial solvency or bring two guarantors. If you fail in one of the offices, you will need to contact another office of the migration service, where the criteria are simpler. One way or another, the efforts to obtain a residence permit in another state will be compensated at least by the fact that under this program you will receive a resident card immediately for 4 years, without the need for an annual renewal. Please note that you will then be able to be absent from Mexico at least until the end of the card’s validity period.
