You have exceeded your permitted period of stay in Mexico. You know that before leaving the country you should go to the migration service office at the airport and pay a fine. But instead, you are asked to sign a document and are told that you don’t need to pay a fine, and after that you can leave Mexico without any problems.
Hooray! It is allowed not to pay the fine! You save 983 pesos (2026). But it's not that simple.
Oficio de salida — This is an official document issued by the migration service and which confirms that the foreigner is allowed to leave the territory of Mexico, despite certain migration discrepancies or pending migration procedures. Simply put, this is an “exit permit”, which is not issued to everyone, but only to those who have a problem with their legal migration status.
When you exceed your authorized period of stay, you have lost legal status in Mexico and committed an administrative violation. Considering your age, when leaving through the airport, the migration service has the right to allow you to leave Mexico only after:
- payment of a fine, or
- signing oficio de salida.
In most cases, permission to leave is given after paying the fine. From the service employee issues a confirmation or stamps your boarding pass, and you go to check-in or boarding. But recently, travelers have begun to report that instead of a fine, they are asked to sign an oficio de salida. This is especially practiced at Mexico City airport.
Oficio de salida — two page document. It has several important points.
1. The reason for registration is indicated:
- there is no migration document confirming the legality of stay (for example, the permitted period on the stamp in the passport has expired, the paper FMM form was lost if you had one, or the resident card is expired),
- there is no entry record in the database (SETRAM) (entered without registration from the USA or illegally through the southern border),
- incomplete migration process, which will be terminated upon departure (they applied for refugee status or a residence permit, but did not wait to acquire the status),
- voluntary refusal from migration status.
2. Permitted to leave Mexico, for which 72 hours are given, counting from the date of notification. When non-compliance with the provisions of the document, the migration service reserves the right to take appropriate measures.
3. Four signatures: an official, a foreigner and two witnesses.
You need to understand that oficio de salida — This is not deportation, it is just permission to leave Mexico.
We usually say that if you violate the permitted period of stay, but pay a fine before the summer, consider that you have “atonement”, and the violation will not affect subsequent entries to Mexico. But we cannot say this if the oficio de salida is formalized.
The procedure for registering an oficio de salida means that a record is made in the migration database that the foreigner has already violated the migration regime. This is not an entry ban, it is a kind of «alert» — a warning to the migration officer that a foreigner must be checked more carefully upon entry. And he will check everything very carefully: return ticket, accommodation reservation, purpose of trip… He will take your passport and go to consult with a senior person. And if there is the slightest doubt, it will be easier for him to refuse you entry.
We do not know whether it is allowed to say from signing the oficio de salida (most likely not). We simply warn that the oficio de salida may have negative consequences for future entries to Mexico.
